Rhode Island man's Tortola murder trial begins on October 8.
(October 8) David Swain's trial begins 10 years after his wife died on a routine dive off of Tortola.
Swain and his wife, Shelly Tyre of Jamestown, Rhode Island were on a vacation on the British Virgin Island capital. And on March 12, 1999, the couple dove the "Twin Wrecks", a dive that features two sunken tug boats that lie in 80 feet of water. Shelley did not return from the dive; Her husband did.
The death was originally ruled an accident by Tortola authorities and Swain was cleared.
However after Swain lost a civil suit to the parents of Shelly Tyre in 2006, Tortola authorities reopened the case and brought Swain up on charges. Swain has retained a Tortola defense lawyer and the Boston law firm of Denner/Pellegrino for his trial.
